2. Eligibility and Account Creation

3.1 Minimum Age and Legal Capacity

IMMEBLE is strictly intended for adults. To create an account and use the platform, users must be at least eighteen (18) years of age (or the age of legal majority in your jurisdiction, if higher). By using IMMEBLE, you represent and warrant that you are legally capable of entering into binding agreements and that all information provided is accurate. IMMEBLE reserves the right to request mandatory age verification at any time and suspend accounts failing to provide satisfactory proof.

3.2 Account Integrity and Security

Users may be required to provide details including Name, Mobile Number, Email, Date of Birth, Gender, Profession, Profile Photo, and Location data. You are strictly limited to a single active account unless expressly authorized. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account. You must immediately notify us of any unauthorized access.

3.3 Background Checks Reservation

While IMMEBLE does not routinely conduct criminal background checks on its users, we explicitly reserve the right to conduct such checks (including sex offender register searches) at our sole discretion, using available public records or trusted third-party providers, to ensure platform safety.

3. User Verification Mechanisms

To improve trust, safety, and platform integrity, IMMEBLE employs robust verification processes. These may include Mobile, Email, Selfie/Liveness, Video, Location, and Government-Issued Identification Verification. Verification requirements may vary depending on the specific services utilized. Submission of fraudulent verification documents is a severe breach of these Terms and will result in immediate permanent banning and potential legal reporting.

4. Nature of the Platform and Real-World Interactions

Assumption of Risk for Offline Meetings

IMMEBLE is solely a technology platform that facilitates discovery and communication. We do not supervise, direct, monitor, control, employ, manage, or participate in offline interactions between users.

You are solely responsible for deciding whether, when, where, and how to meet another user. IMMEBLE strongly mandates meeting in safe, public, and well-populated locations (such as cafes, restaurants, or community spaces). Users choosing to meet in private locations do so entirely at their own discretion and extreme risk. IMMEBLE does not guarantee successful meetups, user compatibility, user honesty, or safety.

5. User Conduct and Prohibited Activities

Users are expected to maintain respectful, lawful interactions both online and offline. The following activities are strictly prohibited and constitute grounds for immediate account termination:

• Fraud & Impersonation: Creating fake accounts, using stolen information, impersonating others, or maintaining duplicate accounts.
• Harassment & Abuse: Bullying, stalking, intimidating, threatening, or engaging in hate speech or abusive conduct.
• Illegal Activities: Using the platform for money laundering, human trafficking, solicitation of sex work/prostitution, distribution of illegal substances, or unauthorized financial solicitations (e.g., Ponzi schemes).
• Spam & Solicitation: Mass messaging, transmitting malicious links, promoting unauthorized services, or harvesting user data.

6. User-Generated Content and Intellectual Property

7.1 Content License

You retain ownership of the content you upload (photos, texts, videos). However, by uploading content, you grant IMMEBLE a worldwide, transferable, sub-licensable, royalty-free right and license to host, store, display, reproduce, modify, and distribute that content for the purpose of operating, protecting, and improving the platform.

7.2 Intellectual Property Rights

All rights, title, and interest in and to IMMEBLE (including its name, logos, source code, designs, algorithms, and features) are exclusively owned by TRILLIONEXA SYSTEMS LLP. You may not copy, modify, reverse engineer, distribute, sell, or commercialize any part of our platform without explicit written authorization.

7.3 Copyright Infringement & Intermediary Guidelines

In compliance with the Information Technology Act, 2000 (India) and the Intermediary Guidelines, IMMEBLE respects intellectual property rights. If you believe your copyrighted work is being infringed, you may submit a takedown request to our Grievance Officer at admin@immeble.com.

7. Payments, Subscriptions, and Billing

IMMEBLE may offer paid services, subscription plans, and premium features. All payments are processed through certified third-party providers (e.g., Razorpay, Stripe).

• Auto-Renewal: If you purchase an auto-recurring periodic subscription, your payment method will continue to be billed until you explicitly cancel.
• Refunds: Unless explicitly mandated by applicable law or stated in our separate Refund and Cancellation Policy, all charges for in-app purchases are strictly non-refundable.
• Service Changes: IMMEBLE reserves the right to modify pricing structures, suspend features, or alter paid service benefits at any time with reasonable notice.

8. App Store and Device Specific Terms

If you access IMMEBLE via an application downloaded from the Apple App Store or Google Play Store, you acknowledge that these Terms are concluded between you and IMMEBLE, not with Apple or Google. Apple and Google are not responsible for the App or the content thereof, and have no obligation to furnish any maintenance or support services with respect to the App.

9. Disclaimers and Limitation of Liability

10.1 Disclaimer of Warranties

IMMEBLE is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied. We do not warrant that the platform will be error-free, secure, or continuously available. We make no guarantees regarding user identity, intent, or behavioral outcomes.

10.2 Limitation of Liability

To the absolute maximum extent permitted by applicable law, TRILLIONEXA SYSTEMS LLP, its partners, directors, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to personal injury, emotional distress, lost profits, or property damage arising out of your use of the platform or offline interactions. In no event shall our total aggregate liability to you exceed the greater of the amount you paid us in the past six (6) months or INR 5,000.

10. Indemnification

You agree to defend, indemnify, and hold harmless TRILLIONEXA SYSTEMS LLP, IMMEBLE, its partners, officers, employees, affiliates, and agents from any and all third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your interaction with any other user.

11. Dispute Resolution and Governing Law

12.1 Informal Resolution

You agree to first attempt to resolve any dispute informally by contacting team@immeble.com.

12.2 Arbitration Agreement

Any dispute arising from or relating to these Terms or the platform shall be resolved through binding arbitration conducted in India, following applicable Indian laws (Arbitration and Conciliation Act, 1996). The arbitration shall be conducted in English and the seat of arbitration shall be Mumbai, Maharashtra.

12.3 Governing Law

These terms shall be governed by the laws of the Republic of India. Subject to the arbitration clause, the courts of Mumbai, Maharashtra shall have exclusive jurisdiction.

12. Force Majeure and Severability

IMMEBLE shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to natural disasters, pandemics, war, cyberattacks, or internet outages. If any provision of these Terms is held to be invalid or unenforceable, that provision will be modified to the extent necessary to make it enforceable, and the remaining provisions will remain in full force.

13. Modifications to Terms

IMMEBLE reserves the right to modify these Terms at any time. Material changes will be communicated via the platform, website, or email. Your continued use of the platform after such modifications constitutes your binding acceptance of the updated Terms.

Final Acknowledgement

By creating an account, accessing the platform, communicating with users, participating in activities, arranging meetings, or otherwise using IMMEBLE, you acknowledge that you have read, understood, and agreed to these Terms of Service in their entirety.
